{"id":1092,"date":"2013-08-23T20:48:34","date_gmt":"2013-08-24T02:48:34","guid":{"rendered":"https:\/\/jaygoodman.com\/?p=1092"},"modified":"2021-12-28T14:19:25","modified_gmt":"2021-12-28T21:19:25","slug":"kinship-guardianship-in-new-mexico","status":"publish","type":"post","link":"https:\/\/jaygoodman.com\/?p=1092","title":{"rendered":"Kinship Guardianship in New Mexico"},"content":{"rendered":"<p dir=\"ltr\" id=\"docs-internal-guid-5c482f0c-adf2-3b85-cad6-521bd077d494\"><a href=\"https:\/\/jaygoodman.com\/wp-content\/uploads\/2013\/08\/Kinships-Guardianship-in-New-Mexico.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1094 alignleft\" alt=\"Kinship Guardianship in New Mexico\" src=\"https:\/\/jaygoodman.com\/wp-content\/uploads\/2013\/08\/Kinships-Guardianship-in-New-Mexico-191x300.jpg\" width=\"191\" height=\"300\" srcset=\"https:\/\/jaygoodman.com\/wp-content\/uploads\/2013\/08\/Kinships-Guardianship-in-New-Mexico-191x300.jpg 191w, https:\/\/jaygoodman.com\/wp-content\/uploads\/2013\/08\/Kinships-Guardianship-in-New-Mexico-653x1024.jpg 653w, https:\/\/jaygoodman.com\/wp-content\/uploads\/2013\/08\/Kinships-Guardianship-in-New-Mexico.jpg 897w\" sizes=\"auto, (max-width: 191px) 100vw, 191px\" \/><\/a>We frequently receive inquiries from grandparents, aunts and uncles or other extended family who inquire about their ability to obtain guardianship of a minor child. \u00a0While the New Mexico Kinship Guardianship Act does provide legal authorization and a process for a relative to obtain a guardianship of a child of a relative, there are certain requirements that must be satisfied to successfully obtain guardianship. \u00a0We have provided an overview of the requirements imposed in this type of New Mexico Child Custody Dispute.<\/p>\n<p>The first point that must be kept in mind is that the right of parents to raise their own children as they see fit is a highly protected right under the U.S. Constitution. \u00a0The right to provide for the care and comfort of one\u2019s own children is considered a \u201cfundamental right\u201d so the government may only intervene and infringe on this right with a compelling reason and must not adversely impact the rights of parents beyond what is necessary to obtain this compelling state interest. \u00a0The public policy of New Mexico reflects these constitutional principles so it is presumed that it is in the best interest of children to be raised by their parents. \u00a0Nonetheless, courts do grant guardianships to relatives under the Kinship Guardianship Act under certain circumstances.<\/p>\n<p>Although the best interest of the child is the general standard for determining child custody disputes under New Mexico family law, this inquiry alone is not sufficient to trump parental rights protected by the Constitution. \u00a0The standard for obtaining a guardianship under the Kinship Guardianship Act requires that the moving party satisfy a two part inquiry. \u00a0The first prong of the test for guardianship under the act involves establishing at least one of the following:<\/p>\n<ul>\n<li dir=\"ltr\">\n<p dir=\"ltr\">Both parents (assuming both parents are alive) must consent to the guardianship in writing; or<\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\">The parental rights of the parents must have been legally terminated or suspended; or<\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\">The minor child but not the child\u2019s parents must have lived with the party seeking guardianship for the ninety days prior to filing for guardianship.<\/p>\n<\/li>\n<\/ul>\n<p>While a relative must satisfy one of these conditions to obtain a guardianship, this is only the first requirement that must be satisfied. \u00a0The party seeking a guardianship in New Mexico must also establish that the parent(s) with legal custody of the minor child is unable or unwilling to provide satisfactory supervision and care to the minor child. \u00a0\u00a0\u00a0This essentially amounts to showing a lack of parental fitness because of conduct like substance abuse, physical abuse, chronic neglect or abandonment. \u00a0The law also provides that guardianship can be granted under this second prong of the test under \u201cexceptional circumstances\u201d that would provide a basis to terminate parental rights. \u00a0If evidence is provided that a child may suffer severe emotional or physical harm or other serious detriment, this may form a basis for granting a guardianship. \u00a0If a parent who is absent for three years or more, this also might constitute an exceptional circumstance, but this is not necessarily the case.<\/p>\n<h4><span style=\"color: #0000ff;\"><a title=\"Protective Proceedings in New Mexico\" href=\"https:\/\/jaygoodman.com\/protective-proceedings-in-new-mexico\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #0000ff;\"><strong>Read up on\u00a0Protective Proceedings in New Mexic<\/strong><\/span><\/a><a title=\"Protective Proceedings in New Mexico\" href=\"https:\/\/jaygoodman.com\/protective-proceedings-in-new-mexico\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #0000ff;\"><strong>o<\/strong><\/span><\/a><\/span><\/h4>\n<p>The above information is provided to illustrate general principles of law and should not be interpreted as a specific legal opinion on an individual case.
